2. Ordering and Payment

2.1 Placing an Order: When you place an order, you are offering to purchase products under these Terms. All orders are subject to availability and acceptance by us. We may refuse or cancel any order at our discretion, including for suspected fraud or pricing errors.
2.2 Payment: Payment must be made in full at the time of ordering. We accept major credit and debit cards via secure payment processors. We do not store your payment details.
2.3 Pricing: All prices are in GBP and include VAT at the applicable rate (currently 20%), unless otherwise stated. Prices may change at any time, but changes will not affect orders already confirmed. If we discover a pricing error, we will inform you and give you the option to proceed at the correct price or cancel the order.
2.4 Order Confirmation: Upon successful payment, you will receive an order confirmation email. This does not guarantee stock availability but confirms we have received your order. We will notify you if any items are unavailable.

3. Delivery

3.1 Delivery Options: We offer standard and express delivery options within the UK. Delivery times are estimates and not guaranteed.
3.2 Delivery Charges: Delivery charges are calculated at checkout based on your location and selected delivery method. 
3.3 Risk and Title: Risk of loss or damage to products passes to you upon delivery. Ownership transfers once we receive full payment.
3.4 Delays: We aim to dispatch orders within 1-2 working days. We are not liable for delays caused by couriers, strikes, or other events beyond our control.
3.5 Undeliverable Orders: If an order cannot be delivered due to an incorrect address or refusal to accept delivery, you may be responsible for additional delivery costs.

4. Returns and Refunds

4.1 Consumer Returns: If you are a consumer (purchasing outside of a business or trade), you have 30 days from receipt to return unused, undamaged products for a full refund, excluding delivery charges. You must notify us via email at sales@toolempire.com and follow our returns process.
4.2 Faulty or Incorrect Items: If a product is faulty, damaged, or incorrect, contact us within 7 days of receipt. We will arrange a replacement or refund, including reasonable return shipping costs.
4.3 Trade Customers: If you are a trade customer, returns are accepted only for faulty or incorrect items, subject to inspection. Non-faulty returns are at our discretion.
4.4 Exclusions: Custom orders, perishable goods, and items marked as non-returnable are not eligible for returns unless faulty.
4.5 Refund Processing: Refunds will be issued to the original payment method within 14 days of receiving the returned item.

5. Liability

5.1 Consumer Liability: If you are a consumer, we are not liable for:

• Losses that were not foreseeable at the time of your order.

• Losses caused by your failure to follow product instructions.

• Business losses, including loss of profits or opportunities.
  5.2 Trade Customer Liability: If you are a trade customer, we are not liable for any business losses, indirect or consequential losses, or losses not directly caused by our breach of these Terms. Our total liability is limited to the price of the products purchased.
  5.3 General: Nothing in these Terms excludes or limits our liability for death, personal injury, fraud, or any other liability that cannot be excluded under English law.

6. Product Use and Compliance

6.1 Intended Use: Products are intended for use in the UK and comply with UK standards. We do not guarantee compliance with laws outside the UK.
6.2 Age Restrictions: Some products (e.g., certain tools) are age-restricted. By ordering, you confirm you are over 18 or have appropriate authorization. We may request age verification.

Tool Empire reserves the right to modify or terminate discount offers at any time without prior notice.
